Keep in mind that it becomes impossible to acquire a right except for a fixed exception
when the newspaper, the magazine, the society, etc. announced the contents of an idea
before application for patent and an industrial new design, or when a show sends an idea
article or it is market.

Although the term of patent right is 20 years from the day of applicaton in principle,
patent right is not given if examination of the Patent Office has not passed.
And in order to undergo the examination, you have to take the necessary procedure for a request
for examination within 3 years from the day of application.

On the other hand, the term of utility model patent is 6 years from the day of application.
Although it is short, utility model patent is effective and significant right about
the fashion article of a short life cycle.
It will be given by no examining from the day of application
(it takes several months from the day of application).

Since a trademark right cannot be acquired when others apply for a same or similar trademark previously
and have received registraction about goods, and (the same as that of the goods which use the trademark
although a right is acquirable even if it uses a trademark before application, or service, or similar)service,
it is necessary to investigate in advance.
